Strategic Consultation Engagement
Tim has litigated leading consultation cases, and represented clients in major resource project applications before the National Energy Board, BC Utilities Commission and Federal and Provincial environmental assessment panels. He advises clients on effective consultation engagement that protects title and rights, maintains a strong legal position, and advances communities’ goals.
Negotiations

Tim represents clients in complex negotiations with governments and companies dealing with resource development, revenue sharing, environmental impact management and shared-decision making. He has experience in the negotiation and drafting of IBA’s with companies in the mining, energy and forestry sectors, as well as negotiating Strategic Engagement Agreements and other forms of government-to-government agreements. Tim also acts as counsel to Nations in the BC Treaty Process, including the negotiation and drafting of chapters and interim Treaty measures.

 

Governance
Tim works with clients to develop internal governance processes and laws that are suited to the client’s capacity, culture and objectives. He has experience in developing Land Codes and laws under the Framework Agreement on First Nations Land Management, and advises Band councils on governance structures and processes that ensure community engagement and responsible governance.
Dispute Resolution and Process Facilitation
Tim applies his skills in mediation and dispute resolution to help clients build positive, consensual outcomes on issues that matter. He brings a solutions-oriented approach to every problem, and uses dispute resolution training to secure positive outcomes in negotiations with companies and governments, as well as working with leadership and communities to ensure solid support for important decisions.
Strategic Litigation
Tim has spent many years fighting for aboriginal title and rights in the courts, and works with clients to be “litigation ready” in case court is the only option left. He knows how to develop the evidence, protect a client’s legal position, and maintain litigation leverage.
